Guidelines For Pesticide Registration In Nigeria

 These guidelines are for the interest of the general public and in particular pesticide industries in Nigeria. It is important to emphasize that, no pesticide chemical product shall be manufactured, imported, advertised, offered for sale or distributed in Nigeria unless it has been registered in accordance with Pesticide Registration Regulations of 1996 and the accompanying guidelines. 

It is the responsibility of the applicant to ensure safe disposal of all expired stock in consultation with the appropriate government bodies.

APPLICANT

(a) An application for the registration of a pesticide product shall. be made by the manufacturer

(b) In case of a manufacturer outside Nigeria, such shall be represented by a duly registered company: (c) An applicant for a manufacturer outside Nigeria must file evidence of POWER OF ATTORNEY from the manufacturer which authorizes him to speak for his Principal on all matters relating to the latter’s specialties.

The original Power of Attorney is to be notarized by a Notary Public in the country of origin and submitted to NAFDAC.

Or Contract Manufacturing Agreement (where applicable). This should be notarized by a Notary Public in the country of origin and submitted to NAFDAC.

NOTE:

1. The representative in Nigeria, whether a corporate body or an individual with the Power of Attorney will be responsible for ensuring that the competent authority in the country is informed of any serious hazard newly associated with the product imported under the provisions of the regulations or of any abuse of the Certificate such as the importation of falsely labeled, spurious or substandard pesticide products.

2.(a) The applicant must submit a written application to the Director, Registration and Regulatory Affairs Directorate, NAFDAC, stating name of manufacturer, common/chemical name, brand name (where applicable) and obtain the prescribed application form which must be properly filled with all the information required.

(b) A separate application form shall be submitted for each pesticide product. In this context, a pesticide product means a separate pesticide formulation.

3. For pesticide products manufactured in Nigeria, applicant shall apply to establishment Inspection Directorate for inspection of the manufacturing plant.

DOCUMENTATION

• The manufacturer, in the case of imported products, must show evidence that they are licensed to manufacture pesticides for sale in the country of origin and that the sale of the product does not constitute a contravention of the laws of that country. (Certificate of manufacture and free sale). Such evidence must be by the competent authority of the country of manufacture and shall be authenticated by the Nigerian Mission in that country. In countries where no Nigerian Embassy or High Commission exists, any other Embassy or High Commission of any Commonwealth or West African country can authenticate.

• Certificate of Registration of Brand Name with the trademark Registry in the Ministry of Commerce in Nigeria, Abuja (where applicable). This should be done in the name of the owner of trademark as the case may be.

• Certificate of Incorporation of representative company with the Corporate Affairs Commission in Nigeria.

• Certificate of Analysis for the batch of the pesticide product to be submitted.

• Radioactive Test Certificate (where applicable).

• The product dossier made out in accordance with the Agency’s format.

• A letter of Invitation to inspect the factory abroad stating the full location address of the manufacturer, Name of contact person, e-mail address, current phone no. & fax no., guide map illustrating the shortest land/air route to the factory

PRODUCT

1. A pesticide product shall not be manufactured in Nigeria, unless the factory is inspected and certificate of recognition is issued by NAFDAC.

2. There must be evidence that such pesticide product may be used without great hazard to human, animal and the environment. In the case of products known to be toxic, there must be indicated precaution, in order to protect human, animals and the environment.

3. The application shall indicate the class of product i.e. whether fungicides insecticides, herbicides, fumigants and rodenticides.

LABELING

1. Labeling shall be informative, clear and accurate.

2. Minimum requirement on the package label shall include:

(a) Name of product, (brand name (where necessary) and chemical name(s) of Active ingredient(s) in weight or volume of each,

(b) Net content.

(c) Batch number, manufacturing date, Expiry date (As appropriate).

(d) Name & location address of manufacturer.

(e) Precautions for storage and handling.

(f) Directions for safe use

(g) Disposal method

3. Any pesticides product whose name, package or label bears close resemblance to an already registered product or is likely to be mistaken for such registered product, shall not be considered for registration.

4. Any pesticide product which is labeled in foreign language, shall not be considered for registration unless an English translation is included on the label and package insert.

TARIFF

All payments to the Agency shall be in bank draft in favour of National Agency for Food and Drug Administration and Control (NAFDAC)

1. Application form Five Hundred Naira Only (N500)

2. Per pesticides product Two hundred thousand naira plus 5% VAT (=N=200,000:00 + 5% VAT)

3. Locally made pesticides Thirty thousand naira plus 5% VAT (=N=30,000:00 + 5% VAT).

 

NOTE: Registration timeline is eighty (60) work days.
